1. General
The following conditions of use apply to all contracts, deliveries and other services.
We therefore contradict deviating regulations of the contracting party.
All special aggreements require our written confirmation.
The company EVO Informationssysteme GmbH is always entitled to change or extend these conditions of use, including all attachments, after announcing to do so within an appropriate period ahead of time.
Orders received prior to this will be processed according to the still valid conditions of use.
2. Offers
Our offers are without obligation. Minor deviations and technical changes compared to descriptions and illustrations may exist.
The current catalogue will become invalid upon releasing a new version.
3. Delivery and Payment
The shipping and payment conditions of the company EVO Informationssysteme GmbH are explained during checkout process.
Ordering via online shop is permitted for manufacturing companies only, others interested, please contact the company EVO Informationssysteme GmbH directly.
There is no minimum order quantity. The prices do not include taxes. All prices are valid for shipping according to INCOTERMS EXW (ex works).
We reserve the right of partial delivery as long as this appears to be the quickest way of delivering a given order.
Special types of delivery requested by the customer will be billed according to common additional costs.
4. Delivery Times
Goods currently available at the warehouse usually reach their destination within 7 days after shipping, considerably more time is required for delivery outside of Europe.
(we cannot be held responsible for transportation problems)
Goods not available at the warehouse when the order is issued will be delivered as soon as possible.
In case the time for delivery cannot be met due to higher force, strikes, unpredictable obstacles or other circumstances outside our range of influence, the time for delivery will be appropriately extended.
In case the time for delivery is not met due to other reasons, the customer is entitled to set an extended time for delivery in writing, issuing a refusal menace and, after the unsuccessful expiration, withdraw from the contract.
In case the inability of delivery is based on the inability of the manufacturer or supplier, both, we and the customer can withdraw from the contract as long as the agreed date of delivery is exceeded by more then 2 months.
Claims for damages resulting from delay or inability, including those developed prior to retreat from the contract are excluded,
except a legal representative of the company EVO Informationssysteme GmbH acted deliberately or roughly negligently.
5. Return Right
For unused goods we grant return rights for 14 days.
The return period will be protected by shipping goods within the prescribed period (date of invoice).
Returns will only be accepted if sufficiently franked.
The return right is not valid on special offers.
6. Passage of the Risk
The risk is passed to the customer by sending off the goods. (according to INCOTERMS EXW, ex works)
7. Warranty
The company EVO Informationssysteme GmbH guarantees that goods sold are free of material or production defects during passage of risk, and that they fulfill the published characteristics.
Immediately upon receiving the goods, it is the customers responsibility to check their condition.
In case of obvious or hidden damages, they have to be reported to us in writing within 10 days.
Otherwise there is no warranty for these damages.
The warranty covers 24 months after delivery.
In case of complaints, the purchase date has to be proven via invoice.
The product has to be mailed to us, sufficiently franked, including a copy of the invoice.
The warranty does not cover ordinary wear and tear.
In case the customer modifies goods, the warranty becomes invalid.
§ 476a BGB ("German Civil Law Book") applies.
8. Retention of Property
Goods remain property of the company EVO Informationssysteme GmbH until they are completely paid for.
9. Data Storage
According to § 28 of BDSG ("German Data Security Act") we inform you, that data required for processing your orders will also be processed and saved.
Personal data will be handled confidentially.
10. Area of Jurisdiction
Area of jurisdiction for both parties is the location of the company EVO Informationssysteme GmbH.
Only the law of the Federal Republic of Germany applies.
